The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. These Terms and Conditions (“Terms”) govern your participation in the employee SMS messaging program operated by Townsend Inc. dba Dothan Powersports (“Company,” “we,” “us,” or “our”). By providing written consent to receive SMS messages, you agree to these Terms.

Program Description

Our employee SMS messaging program is an internal communication tool used exclusively for work-related purposes. Through this program, enrolled employees may receive:

  • One-Time Passwords (OTPs): Security codes for accessing company web services and internal systems.
  • Deal Notifications: Alerts and reminders related to customer deals and job responsibilities.

This program is exclusively for employees of Dothan Powersports and is not available to customers or the general public.

Consent and Enrollment

Enrollment in the SMS messaging program is voluntary. To participate, you must provide written consent by signing the SMS authorization form during your new hire onboarding process. Your signed consent form will be scanned and stored in your employee file.

By signing the consent form, you confirm that:

  • You are the owner or authorized user of the mobile phone number provided.
  • You consent to receive work-related SMS messages at the number provided.
  • You understand that message and data rates may apply based on your mobile carrier plan.

Message Frequency

Message frequency varies based on your job role and system usage. On average, enrolled employees may receive up to 15 messages per week. Message volume may be higher or lower depending on business needs and your use of company systems requiring OTP verification.

Costs and Charges

The Company does not charge you for SMS messages sent through this program. However, standard message and data rates from your mobile carrier may apply. Please consult your mobile service plan for details about any charges you may incur.

Opting Out

Your participation in this SMS program is voluntary, and you may opt out at any time. To stop receiving messages:

  • Reply STOP: Text STOP to any message you receive from us. You will receive a confirmation message and will no longer receive SMS messages from this program.
  • Email Request: Send an opt-out request to admin@dothanpowersports.com.

Additional opt-out keywords that are recognized: OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOPALL.

Please note that opting out of SMS messages may affect your ability to access certain company systems that require OTP verification. Contact your supervisor or IT department if you have concerns.

Disclaimers

While we strive to deliver messages promptly and reliably, we cannot guarantee message delivery. SMS delivery depends on factors beyond our control, including your mobile carrier’s network, device settings, and coverage area. We are not responsible for delayed or undelivered messages.

Do not rely solely on SMS messages for time-sensitive communications. If you do not receive an expected OTP or notification, please contact your supervisor or IT department.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify enrolled employees through appropriate means. Continued participation in the SMS program after changes are communicated constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.
